Realistically, on any construction of the law, Gerrard was guilty of affray. I am if anything surprised the CPS dropped the more serious charge of s47. He elected Jury trial and we see why. Starstruck and also persuaded by references which have absolutely nothing to do with the commission of the offence he has gotten away with it.
Realistically, his references would have been relevant at sentencing and given his exceptionally good character he would have likely received a suspended prison sentence, large fine and community service. But no custodial (unless he breaches the terms of his sentence or commits further offence in which case his suspended becomes automatically active). Even the LFC fans in work think it is the wrong decision but there we are.
This is why he elected Crown Court. If he had have elected Magistrates Court he would have been found guilty but of course they do not have the same sentencing powers as Crown Court so there was always a risk.
